1 General Terms and Conditions

1.1. These terms and conditions of the online shop www.biovalik.ee govern the legal relationship between the operator of the online shop (BioValik OÜ) and persons purchasing products (hereinafter referred to as the ‘Purchaser’).

1.2. By visiting, using or logging into the online shop, the user confirms that they have read and understood these terms and conditions and agree to them in full.

1.3. The Seller referred to in these Terms and Conditions is BioValik OÜ, registration number: 17492548, registered address: Peterburi tee 46, Lasnamäe district, 11415 Tallinn, Republic of Estonia (hereinafter the Seller).

1.4. The Buyer is a natural or legal person who makes purchases in the online shop (hereinafter referred to as the Buyer).

1.5. The privacy policy and cookie policy form an integral part of the terms and conditions of purchase.

1.6. If a user does not agree to the terms and conditions of purchase, they are not entitled to use the online shop.

1.7. The seller reserves the right to unilaterally amend the terms and conditions of sale. Any amendments shall come into force upon their publication in the online shop.

1.8. The seller does not guarantee the uninterrupted and error-free operation of the online shop and accepts no liability for any loss arising from technical faults.

1.9. Users are prohibited from disrupting the operation of the online shop or circumventing security measures.

2. Terms

2.1. E-shop – A seller-managed online platform at www.biovalik.ee.

2.2. Shopping basket – Items selected by the customer but not yet paid for.

2.3. Order – Goods confirmed and paid for by the customer.

2.4. Registered buyer – a person who has created a user account.

2.5. Unregistered buyer – a buyer without an account.

3. Concluding a contract

3.1. The sales contract comes into force once the payment made by the Buyer has been credited to the online shop’s bank account.

3.2. The buyer undertakes to provide accurate details and to pay for the order.

3.3. The seller undertakes to deliver the order in accordance with the terms and conditions.

4. Processing of personal data

4.1. By entering their details in the online shop and providing the relevant confirmation, the Consumer grants the right to collect and process their personal data (name, contact telephone number, parcel delivery address and/or home address, email address) and to pass on personal data to a logistics partner for the purpose of delivering the goods.

4.2. Consumers have the right at any time to object to the collection and use of their personal data, except where this is necessary for the fulfilment of a contractual obligation or for the delivery of goods.

4.3. Electronic personal data will only be used for direct marketing if the Consumer has given their separate consent for this at www.biovalik.ee.

4.4. When paying for purchases, the consumer’s personal banking details are secured via encrypted data transmission with banks, to which the online shop has no access.

5. Prices and payment

5.1. All prices are in euros. The seller is not liable for VAT, so no VAT is added to the sales prices, and VAT is not shown on invoices.

5.2. Delivery charges are added to the price and are shown when you complete your order.

5.3. The seller reserves the right to change prices without prior notice.

5.4. Payment methods: online banking, payment card or other methods accepted by the online shop.

6. Order fulfilment and delivery

6.1. Orders are processed on working days.

6.2. Once the sales contract has come into effect, the online shop www.biovalik.ee will prepare the order and hand it over to the company’s logistics partners for delivery.

6.3. The delivery times shown on the online shop’s website apply from the moment the order amount is credited to the online shop’s bank account.

6.4. Delivery usually takes place within 1–4 working days after the customer has placed their order in Estonia.

6.5. Goods are delivered to the address specified by the customer within the territories of the Republic of Estonia, the Republic of Latvia, the Republic of Lithuania and the Republic of Finland.

6.6. The customer is obliged to provide accurate and complete details when placing an order, as the prompt and smooth delivery of the goods depends on the accuracy of the information provided.

6.7. If delivery fails for reasons attributable to the Buyer, the Seller may cancel the order or charge an additional fee for a redelivery.

6.8. The buyer undertakes to check that the goods comply with the order upon receipt.

6.9. The buyer is obliged to notify the seller immediately of any goods with damaged packaging by emailing info@biovalik.ee, and to attach a photograph of the consignment to the notification.

7. Product availability

7.1. If an ordered item is out of stock, the Seller will refund the amount paid for it.

7.2. In the event of a partial shortage, the cost of the missing goods will be refunded.

8. Right of withdrawal

For goods purchased from the BioValik.ee online shop, you have a 14-day right of withdrawal, which begins upon physical receipt of the goods.

8.1. When returning goods to the seller, the following conditions must be observed:

• Returned goods must be unused, undamaged and sealed in their original packaging (this does not apply to goods returned due to defects).
• The goods must not have been damaged through the buyer’s fault.
  • The goods must be unused and in a condition fit for sale (with undamaged labels, protective film, etc.) (this clause does not apply if goods with defects are returned);
• The product being returned must be complete (containing all items included in the product packaging – leaflets, loose parts, etc.).
• The buyer must store the goods in accordance with the storage conditions specified by the manufacturer.

8.2. The seller reserves the right to refuse to accept returned goods if the buyer does not comply with the returns policy set out at 8.1.

8.3. If, upon receipt of the returned goods, the Seller discovers that they have become unsuitable for resale for reasons of hygiene or health protection, the Seller shall inform the Buyer of this, giving reasons and doing so without delay, shall refuse to refund the payment for that specific item, and shall return the goods to the Buyer at the Buyer’s expense, unless the Buyer has agreed otherwise.

8.4. Products that are not suitable for return for health or hygiene reasons are excluded from the right of return if the product has been opened by the Buyer after delivery (e.g. plasters in sterile packaging, products with safety seals, etc.).

8.5. The buyer must store the goods in accordance with the storage conditions specified by the manufacturer. Any deterioration of the product resulting from a breach of this obligation will be deducted from the refundable amount as a reduction in value, and BioValik OÜ shall not be held liable for any resulting defect.

8.6. The Buyer has the right to submit a notice of withdrawal electronically (via the ‘Withdrawal’ button), which is available in the Buyer’s user account alongside the relevant order. If the purchase was made as a guest (without a user account), information regarding the right of withdrawal and the relevant link to the electronic withdrawal form will be provided in the order confirmation email. The Seller shall confirm receipt of the notice of withdrawal on a durable medium (e.g. by email).

8.7. Goods must be returned no later than 14 days from the date of submitting the notice of withdrawal to the following address: ‘BioValikOÜ’, Tallinn, Lasnamäe district, Peterburi tee 46, 11415, Harju County, or to the nearest parcel locker to this address, or to another location agreed between the Parties.

8.8. The direct costs of returning the goods shall be borne by the Buyer, unless the Seller has previously agreed otherwise in writing or on a durable medium, or has undertaken to bear these costs.

8.9. If the Buyer withdraws from the contract, the Seller shall refund to the Buyer all payments received under the contract, including the price of the goods and the standard delivery costs incurred by the Buyer in connection with the delivery method offered by the Seller.

8.10. Should the Buyer exercise their right of withdrawal after the goods have been dispatched or received, the terms and conditions set out at 8.1–8.8, and the Consumer shall bear the direct costs of returning the goods, unless the Seller has previously agreed otherwise in writing or on a durable medium.

8.11. The Seller shall refund to the Buyer all sums paid by the Buyer without delay, but no later than 14 days from the date the notice of withdrawal is received by the Seller. The Seller is entitled to delay the refund until the goods have been returned to the warehouse.

8.12. Refunds will be made to the Buyer using the same payment method that the Buyer used to complete the transaction.

8.13. The consumer’s right of withdrawal is provided for by law and is not specific to orders placed via the BioValik OÜ online shop.

9. Complaints and non-compliant goods

9.1. If goods purchased from the Biovalik.ee online shop have a defect for which the online shop is responsible, the online shop shall repair or replace the defective goods at the Buyer’s discretion.

9.2. In the event of a valid complaint, BioValik OÜ will repair or replace the defective goods. If repair or replacement is not possible or would be unreasonably costly, BioValik OÜ will refund the amount paid for the goods to the Buyer’s bank account. Delivery costs will be reimbursed only if no other goods were purchased as part of the same order which the Buyer is retaining. In such cases, the delivery costs for the cheapest delivery method will be refunded together with the price of the goods.

9.3. BioValik accepts no liability:

• 9.3.1. For defects arising through the Buyer’s fault after delivery of the goods.
• 9.3.2. For defects arising from the improper use of the product.
• 9.3.3. We accept no liability for any deterioration of the product resulting from storage under conditions that do not comply with the manufacturer’s recommended storage conditions.
• 9.3.4s. For normal wear and tear of the product under normal use.

9.4. The Biovalik.ee online shop shall respond to a complaint submitted by a consumer in writing or in a form that can be reproduced in writing within 14 days.

10. Liability and force majeure

10.1. BioValik OÜ shall be liable to the Buyer, and the Buyer shall be liable to BioValik OÜ, for any direct financial loss caused to the other party by a breach of these terms and conditions, solely to the extent and in the circumstances provided for in the legislation of the Republic of Estonia.

10.2. BioValik OÜ accepts no liability for any loss incurred by the Buyer or for any delay in the delivery of goods if such loss or delay is caused by circumstances beyond the control of BioValik OÜ, which could not have been foreseen or prevented, and the occurrence of which could not reasonably have been avoided (force majeure).

11. Disclaimers and copyright

11.1. www.biovalik.ee The product images displayed in the online shop are for illustrative purposes only and may differ from the actual product.

11.2. BioValik OÜreserves the right to change the prices and terms and conditions of the goods offered in the www.biovalik.ee online shop. If, after an order has been placed, it transpires that the price displayed in the online shop was incorrect due to an obvious error, BioValik OÜreserves the right to withdraw from the sales contract and refund the amount paid by the Buyer without delay, but no later than 14 days.

11.3. BioValik OÜ-l has the right to withdraw from the sales contract if www.biovalik.ee e-shop contains an obvious human error or technical fault regarding the price of a product or any other material term, the existence of which a reasonable Buyer should have been aware of (for example, if the price of a product costing 10 € has been incorrectly entered as 0.1 €).

11.4. BioValik OÜ regularly updates the product information published in the www.biovalik.ee online shop; however, due to incomplete data provided by the manufacturer or supplier, there may be inaccuracies in the product descriptions. BioValik OÜ recommends checking important information, including ingredients, allergens, instructions for use and warnings, directly on the product packaging before using the product.

11.5. All texts, images, product descriptions, design elements and other content published on the www.biovalik.ee online shop are protected by copyright and belong to BioValik OÜor the relevant rights holder. Copying, distributing, modifying or otherwise using these materials without the prior written consent of BioValik OÜ is prohibited.

12. Vääramatu jõud

12.1. The online shop www.biovalik.ee shall not be liable for any loss incurred by the Subscriber or for any delay in the delivery of goods if such loss or delay is due to circumstances which the Ewww.biovalik.ee could not influence or foresee.

13. Dispute resolution

13.1. BioValik OÜ and the Buyer shall endeavour to resolve all disputes through negotiation in the first instance. If no agreement is reached, or if the Buyer does not agree with the solution proposed by BioValik OÜ, the Buyer has the right to refer the matter to the Consumer Disputes Committee. The Committee’s contact details are available at www.komisjon.ee.

13.2. Should no agreement be reached, the dispute shall be settled in the courts of the Republic of Estonia.

13.3. Consumers have the right to use the EU’s online dispute resolution platform.

14. Cookies

14.1. The online shop uses cookies to improve the user experience and to collect statistics.

14.2. Users can restrict the use of cookies in their browser settings.
